Subject:  Exclusion of Housing for Persons with Alcoholism

Homeless Action Committee v. City of Albany, et al., No. 97-CV-0469 (NDNY 1997)

This lawsuit challenged the City of Albany’s refusal to modify the application of its zoning ordinance in order to allow the establishment and maintenance of single room occupancy  (SRO) housing for persons with alcoholism at 393 North Pearl Street.  The complaint alleged violations of the anti-discrimination and reasonable accommodation provisions of the Fair Housing Act and the Americans with Disabilities Act. The parties agreed to a settlement permitting the construction of the housing.
