The Second Circuit reversed the district court’s dismissal for failure to state a claim, holding that (1) Title III of Americans with Disabilities Act (ADA) regulates insurance underwriting practices in at least some circumstances; (2) ADA's regulation of insurance underwriting is not barred by McCarran-Ferguson Act; and (3) applicants were not required to plead that challenged conduct lacked actuarial justification.
