Subject: Accessibility of Movie Theatre Seating

Meineker v. Hoyts Cinemas Corp., No. 98-CV-1526 (NDNY 1998)

Disability Advocates filed this lawsuit because 18 newly-constructed stadium theaters in Albany, New York lacked full access for people who use wheelchairs.  The lawsuit claimed a violation of Title III of the Americans with Disabilities Act.  After several years of litigation, Hoyts agreed to make substantial modifications to its theaters at Crossgates, including ramping into the stadium seating areas of 10 theaters.

Meineker v. Hoyts Cinemas Corp., 69 Fed.Appx. 19 (2d Cir. 2003)

Reversing district court’s grant of summary judgment to defendant and remanding to the district court for consideration of Department of Justice regulations concerning providing patrons in wheelchairs with comparable lines of sight.
