Subject: Indigent Subjects of Committeeship Proceedings Right to Representation
Application of Rodriguez, Greene County Supreme Court, 1992

Disability Advocates intervened in this committeeship proceeding in Greene County Supreme Court (1) to request that counsel be appointed for the indigent woman who was the subject of the proceeding, and (2) to seek a declaration that indigent persons have a due process right to be advised of the right to court appointed counsel, and to the appointment of counsel on request, at public expense if necessary. The Court granted DAI's motion to intervene and declared that indigent subjects of committeeship proceedings have a constitutional right to representation at public expense.
